When deciding whether to become an Airbnb host, it is important for you to understand the laws in your region or city. As a platform and online marketplace we do not provide legal advice, but we want to provide resources that may help you better understand applicable laws and regulations. 

This list is not exhaustive, but it may give you a good start in understanding your local laws. If you have questions, visit the short-term rental homepage or other government agencies directly, or consult a local lawyer or tax professional.

Actions a Host needs to take

Airbnb collects all lodging taxes statewide for Airbnb hosts. Regardless, hosts must get a state Transaction Privilege Sale Tax (TPT) license. The host needs to click on the link that says "Login to AZTaxes" and create an account. More information about AZ taxes can be found at the state’s website here.

  1. The host needs to register their short term rental with the City of Phoenix by following this link;
  2. If the host is not the property owner they will be asked to provide an authorization from the owner that they are authorized to register the property as a short term rental by including a signed copy of this form when they submit application;
  3. The host/applicant will be asked to attest that the property is registered with the Maricopa County Assessor. Property management/ownership should provide proof/confirmation to tenant/applicants that the property is registered as a rental property with the Assessor;

The host should review the ordinance and ensure that they are complying with any additional requirements..

Short-term rental regulations

The Phoenix City Council passed the Short-Term Vacation Rental Ordinance in January 2020. It requires owners of short-term or vacation rentals to register with the city and provide emergency and complaint contact information. The ordinance also outlines prohibited uses of vacation rentals and sets penalties for violations. Check the city’s site for more information about rules for short-term rentals. If you are a tenant or a designee of the property owner with the authority to operate the short term rental you must submit an authorization form to the city which can be found here.

All rentals

All residential rental units - including vacation and short term rentals - must be registered with Maricopa County, in accordance with ARS 33-1902. You can find registration information here.

Taxes

Airbnb collects and remits all relevant taxes related to transient stays booked on Airbnb (if stays are booked on other platforms taxes must be reported and paid separately). Building and housing standards

Phoenix has rules and regulations specifying construction, design, and maintenance standards for buildings, including regulations on habitability, health, and safety.
